El acusado reconoci\u00f3 y acept\u00f3 la responsabilidad y la autor\u00eda de robo simple en grado de tentativa y la pena de 10 meses de prisi\u00f3n en suspenso.<\/h3>\n

En una audiencia celebrada este martes, las partes acordaron concluir una causa mediante el procedimiento de juicio abreviado. El acusado reconoci\u00f3 su participaci\u00f3n en el hecho, la calificaci\u00f3n efectuada y acept\u00f3 la imposici\u00f3n de pena.<\/h3>\n

La audiencia la dirigi\u00f3 la Dra. Daniela Estrada, como presidenta de la C\u00e1mara en lo Penal N\u00b0 2 (residual) de la Segunda Circunscripci\u00f3n Judicial. Estuvieron presentes el Dr. Ernesto Gabriel Lutens \u2013 Fiscal de Juicio \u2013 y por la defensa, el Dr. Diego Velazquez \u2013 conjuntamente con su representado.<\/h3>\n

El hecho ocurri\u00f3 el pasado 9 de Octubre de 2019 a las 23:00 hs aproximadamente. En ese entonces, el imputado estaba circulando en bicicleta por calle Suipacha y al llegar a la altura de 1700 se acerc\u00f3 a un automotor y con un cuchillo procedi\u00f3 a forzar la cerradura del ba\u00fal.<\/h3>\n

Cuando logr\u00f3 abrir el ba\u00fal comenz\u00f3 a sonar la alarma y es en ese momento que el propietario sali\u00f3 y observ\u00f3 al acusado y\u00e9ndose en bicicleta, el cual es perseguido y atrapado. Luego arrib\u00f3 personal policial.<\/h3>\n

En la acusaci\u00f3n fiscal se expresa que determinada la plataforma f\u00e1ctica, se pueda apreciar que el imputado procedi\u00f3 a usar fuerza sobre la medida de seguridad del ba\u00fal del automotor, que tal acci\u00f3n estaba destinada a lograr apoderarse de un bien ajeno.<\/h3>\n

El Fiscal de Juicio inform\u00f3 las condiciones del acuerdo arribado, expres\u00f3 que el hecho se encuadra en el delito de robo simple en grado de tentativa (arts. 164 y 42 del C.P.), como atenuantes su falta de antecedentes de condena y como agravantes no se observan, solicitando la pena de diez (10) meses de prisi\u00f3n en suspenso, accesorias legales y costas procesales.<\/h3>\n

Por su parte, la defensa manifest\u00f3 su adhesi\u00f3n a lo manifestado por el Fiscal de Juicio. En el mismo sentido, Rafael Alejandro Palavecino<\/strong> reconoci\u00f3 y acept\u00f3 la responsabilidad\u00a0 por los hechos que viene acusado y la autor\u00eda de robo simple en grado de tentativa y la pena de 10 meses de prisi\u00f3n en suspenso.<\/h3>\n

Por \u00faltimo, la Dra. Daniela Estrada resolvi\u00f3 suspender el debate oral y declarar admisible la tramitaci\u00f3n de la causa por el procedimiento abreviado teniendo en cuenta lo manifestado por las partes y que se encuentran reunidos los requisitos formales del Art. 363 del C\u00f3digo de Procedimiento Penal (Ley N\u00ba VI-0152-2004).<\/h3>\n
