{"id":15271,"date":"2024-04-25T18:44:16","date_gmt":"2024-04-25T21:44:16","guid":{"rendered":"https:\/\/apuntesdesanluis.com\/?p=15271"},"modified":"2024-04-25T14:48:57","modified_gmt":"2024-04-25T17:48:57","slug":"novedades-en-la-causa-que-investiga-el-robo-con-machete-en-una-quinta","status":"publish","type":"post","link":"https:\/\/apuntesdesanluis.com\/index.php\/2024\/04\/25\/novedades-en-la-causa-que-investiga-el-robo-con-machete-en-una-quinta\/","title":{"rendered":"NOVEDADES EN LA CAUSA QUE INVESTIGA EL ROBO CON MACHETE EN UNA QUINTA"},"content":{"rendered":"<h3>Hoy se desarroll\u00f3 una audiencia en el Juzgado de Garant\u00eda N\u00ba4, donde el Dr. Santiago Ortiz concedi\u00f3 la pr\u00f3rroga de prisi\u00f3n preventiva para dos imputados.<\/h3>\n<h3>En marco de una causa donde se investiga un hecho delictivo ocurrido el pasado 20 de marzo en Villa Mercedes, en la ma\u00f1ana de este jueves se desarroll\u00f3 una nueva audiencia en el Juzgado de Garant\u00eda N\u00ba 4 de la Segunda Circunscripci\u00f3n Judicial.<\/h3>\n<h3>En esta oportunidad, el Dr. Santiago Ortiz extendi\u00f3 la prisi\u00f3n preventiva que dos hombres cumplen en el Servicio Penitenciario Provincial, por el plazo de quince d\u00edas corridos, hasta que se realice la audiencia de control de acusaci\u00f3n.<\/h3>\n<h3>El hecho, seg\u00fan lo relatado por fiscal\u00eda ocurri\u00f3 en una quinta ubicada en la calle Fuerte Constitucional de esta ciudad, all\u00ed se encontraba el propietario. En ese entonces ingresaron dos personas de sexo masculino, una de ellas armado con un machete. Se apoderaron de un celular y se dieron a la fuga trepando un tapial.<\/h3>\n<h3>Antes de fugarse se produjo una pelea entre el propietario que ten\u00eda un machete y los imputados, uno de ellos con otro machete.<\/h3>\n<h3>En primer lugar, el Fiscal explic\u00f3 que la audiencia fue solicitada a fin de pedir la pr\u00f3rroga de la prisi\u00f3n preventiva, en tanto aguardan el resultado de un informe de la compa\u00f1\u00eda de telefon\u00eda celular que permitir\u00eda conocer el destino de llamadas salientes realizadas desde el dispositivo denunciado como robado. Esto, posibilitar\u00eda definir la consumaci\u00f3n o no del hecho. Solicit\u00f3 al tribunal un plazo de quince d\u00edas h\u00e1biles a fin de incorporar al legajo el resultado completo de los informes solicitados.<\/h3>\n<h3>Por su parte, la defensa ejercida por la Dra. Cecilia Mithiaux rechaz\u00f3 el pedido de pr\u00f3rroga de la prisi\u00f3n preventiva y en el mismo sentido se expres\u00f3 el Dr. Pascual Celdr\u00e1n, representante de otro de los imputados.<\/h3>\n<h3>La Dra. Mithiaux consider\u00f3 que no se dan los supuestos exigidos en el Art. 202 del C\u00f3digo de Procedimiento Penal y el Dr. Pascual Celdr\u00e1n mencion\u00f3 condiciones de salud de su asistido y pidi\u00f3 que subsidiriamente, cumpliera la medida de coerci\u00f3n en forma domiciliaria.<\/h3>\n<h3>En la audiencia estuvieron presentes el Dr. Jos\u00e9 Olgu\u00edn \u2013 Fiscal de Instrucci\u00f3n N\u00ba 3- y la Dra. Andrea Court -Fiscal Adjunta-. En representaci\u00f3n de dos de los imputados actuaron las Dras. Cecilia Mithiaux y Noelia P\u00e1ez \u2013Defensa Oficial- y en defensa del otro denunciado, el Dr. Pascual Celdr\u00e1n. Como secretaria intervino la Dra. Nadia Segura.<\/h3>\n<h3>Luego de escuchar a las partes, el Dr. Santiago Ortiz \u2013 Juez de Garant\u00eda N\u00ba 4\u00a0 -, concedi\u00f3 la pr\u00f3rroga de prisi\u00f3n preventiva por el plazo de quince d\u00edas corridos, los que deber\u00e1n cumplirse en el Servicio Penitenciario Provincial; fij\u00f3 audiencia de control de acusaci\u00f3n para el pr\u00f3ximo 10 de mayo. Asimismo, en relaci\u00f3n a los dichos vertidos por las partes en relaci\u00f3n a la existencia de plantas de marihuana en el lugar del hecho, orden\u00f3 informar a la Justicia Federal a fin de que
