{"id":26899,"date":"2024-12-17T21:14:33","date_gmt":"2024-12-18T00:14:33","guid":{"rendered":"https:\/\/apuntesdesanluis.com\/?p=26899"},"modified":"2024-12-17T21:29:17","modified_gmt":"2024-12-18T00:29:17","slug":"fallo-contundente-a-favor-del-colegio-de-abogados-pone-entre-las-cuerdas-al-superior-tribunal","status":"publish","type":"post","link":"https:\/\/apuntesdesanluis.com\/index.php\/2024\/12\/17\/fallo-contundente-a-favor-del-colegio-de-abogados-pone-entre-las-cuerdas-al-superior-tribunal\/","title":{"rendered":"FALLO CONTUNDENTE A FAVOR DEL COLEGIO DE ABOGADOS PONE ENTRE LAS CUERDAS AL SUPERIOR TRIBUNAL"},"content":{"rendered":"<h3>La sentencia exhorta al STJ a convocar un foro de debate que re\u00fana a abogados, magistrados, legisladores y representantes del Poder Ejecutivo, para analizar las fallas del sistema y promover reformas legislativas necesarias.<\/h3>\n<h3>En un fallo hist\u00f3rico, la Jueza <strong>Mar\u00eda Eugenia Bona<\/strong>, del Juzgado Laboral N\u00ba 2, hizo lugar al amparo colectivo presentado por el <strong>Colegio de Abogados de Villa Mercedes<\/strong> (CAVM) contra el Superior Tribunal de Justicia de San Luis (STJ).<\/h3>\n<h3>La acci\u00f3n buscaba abordar la denominada &#8220;crisis judicial&#8221; en la provincia, caracterizada por una morosidad estructural que afecta tanto a abogados como a ciudadanos.<\/h3>\n<h3>El CAVM, representado por su presidenta <strong>Mariela Bettina Blengino<\/strong>, denunci\u00f3 graves retrasos en la resoluci\u00f3n de causas judiciales, calificando la situaci\u00f3n de &#8220;crisis institucional&#8221;. Argumenta que la demora no solo afecta el acceso a la justicia de los ciudadanos, sino tambi\u00e9n el derecho de los abogados al ejercicio pleno de su profesi\u00f3n, vulnerando el art\u00edculo 14 bis de la Constituci\u00f3n Nacional.<\/h3>\n<h3>Por su parte, el STJ, a trav\u00e9s de la Fiscal\u00eda de Estado, consider\u00f3 que el amparo no era la v\u00eda id\u00f3nea, se\u00f1alando que ya exist\u00edan reformas en marcha, como la implementaci\u00f3n de Oficinas de Gesti\u00f3n Unificada (OGU). Sin embargo, la jueza concluy\u00f3 que las modificaciones no han logrado solucionar los problemas estructurales.<\/h3>\n<h3><strong>FUNDAMENTOS DEL FALLO<\/strong><\/h3>\n<h3>La jueza Bona subray\u00f3 la legitimidad del amparo colectivo, sobre la base del art\u00edculo 43 de la Constituci\u00f3n Nacional y en el precedente \u201cHalabi\u201d de la Corte Suprema. En su an\u00e1lisis, destac\u00f3 la afectaci\u00f3n directa a los derechos laborales y alimentarios de los abogados, as\u00ed como el impacto negativo en los justiciables.<\/h3>\n<h3>El fallo tambi\u00e9n incluy\u00f3 referencias a declaraciones testimoniales conmovedoras, que evidenciaron el perjuicio humano detr\u00e1s de los expedientes judiciales. La jueza enfatiz\u00f3 la necesidad de un sistema judicial m\u00e1s \u00e1gil y eficiente.<\/h3>\n<h3><strong>MEDIDAS EXHORTADAS<\/strong><\/h3>\n<h3>La sentencia exhorta al STJ a convocar un foro de debate que re\u00fana a abogados, magistrados, legisladores y representantes del Poder Ejecutivo. El objetivo: analizar las fallas del sistema y promover reformas legislativas necesarias. Asimismo, se remitir\u00e1n copias del fallo al Gobernador, al Ministro de Gobierno y al Vicegobernador de la provincia para su consideraci\u00f3n.<\/h3>\n<h3>El fallo pone de manifiesto la importancia de la justicia como pilar fundamental de la paz social. La jueza Bona cerr\u00f3 su dictamen citando al jurista Couture: \u201cTen fe en el derecho como mayor instrumento para la convivencia humana; ten fe en la justicia como destino normal del derecho&#8230;\u201d.<\/h3>\n<h3>Este acto judicial no solo busca soluciones inmediatas, sino tambi\u00e9n replantear el sistema judicial en su conjunto, para garantizar el acceso efectivo a la justicia en San Luis.<\/h3>\n<h3>La magistrada es la misma que en octubre de 2023 hizo lugar a la medida cautelar presentada por <strong>Claudio Poggi<\/strong>, que orden\u00f3 al entonces gobernador Alberto Rodr\u00b4piguez Sa\u00e1, que suspendiera las contrataciones y licitaciones que excedieran su mandato. La disposici\u00f3n alcanz\u00f3 al Poder Ejecutivo, la administraci\u00f3n central y descentralizada, organismos aut\u00e1rquicos, entes desconcentrados del Estado, agencias, y
