Finalmente, tal como hab\u00eda trascendido este martes, Javier Milei<\/strong> firm\u00f3 los decretos para designar en comisi\u00f3n a Ariel Lijo<\/strong> y Manuel Garc\u00eda Mansilla<\/strong> como jueces de la Corte Suprema.<\/h3>\n

\u201cEl Presidente ha tomado la determinaci\u00f3n de designar en comisi\u00f3n a los doctores Manuel Garcia-Mansilla y Ariel Lijo como jueces de la Corte Suprema de Justicia de la Naci\u00f3n, hasta la finalizaci\u00f3n del pr\u00f3ximo periodo legislativo, con el objetivo de normalizar el funcionamiento del m\u00e1ximo tribunal judicial de nuestro pa\u00eds, el cual no puede llevar a cabo su rol con normalidad con tan solo tres ministros. Durante el mencionado plazo, esta administraci\u00f3n continuar\u00e1 con el tr\u00e1mite legislativo para que la C\u00e1mara Alta ejerza sus atribuciones y preste los correspondientes acuerdos a los pliegos. El Gobierno Nacional no tolera ni tolerar\u00e1 que los intereses de la pol\u00edtica se impongan por sobre los del pueblo argentino, bajo ninguna circunstancia\u201d, anunci\u00f3 en un comunicado Presidencia.<\/h3>\n

En ese sentido, el Gobierno resalt\u00f3 que \u201cen ning\u00fan caso el Senado tiene la potestad para rechazar el acuerdo de los candidatos propuestos por el Presidente en base a preferencias personales o pol\u00edticas de los senadores. De hecho, es la politizaci\u00f3n de la Justicia una de las principales causas de que los argentinos no tengan un servicio de Justicia que resuelva sus problemas. La Constituci\u00f3n claramente establece que es el Presidente, y nadie m\u00e1s, quien tiene la facultad de seleccionar los candidatos para cubrir las vacantes en el M\u00e1ximo Tribunal, limit\u00e1ndose el Senado a prestar su conformidad o rechazarlos en funci\u00f3n de un an\u00e1lisis objetivo de la idoneidad t\u00e9cnica de los candidatos”.<\/h3>\n

De hecho, en el comunicado recordaron \u201ccuando una notable mayor\u00eda del arco pol\u00edtico respald\u00f3 tanto a N\u00e9stor Kirchner como a Mauricio Macri en la designaci\u00f3n temprana de jueces para la Corte Suprema durante sus mandatos. Sin embargo, durante meses, han evadido respetar la decisi\u00f3n de este Gobierno, aun cuando la falta de pronunciamiento implica un grave da\u00f1o al funcionamiento de uno de los tres poderes de la Rep\u00fablica\u201d.<\/h3>\n

A solo cuatro d\u00edas de asumir la Presidencia, el 14 de diciembre del 2015, Mauricio Macri cuando design\u00f3 en comisi\u00f3n a Carlos Rosenkrantz y Horacio Rosatti mediante el decreto 83, 72 horas despu\u00e9s de que se hiciera efectiva la renuncia de Carlos Fayt al m\u00e1ximo tribunal, que sumada a la de Ra\u00fal Zaffaroni de un a\u00f1o antes hab\u00eda dejado a la Corte con Ricardo Lorenzetti, Juan Carlos Maqueda y Elena Highton de Nolasco como sus \u00fanicos miembros.<\/h3>\n

De todos modos, tras cr\u00edticas de la oposici\u00f3n, Rosenkrantz y Rosatti esperaron para tener el aval del Senado y reci\u00e9n ah\u00ed jurar en la Corte.<\/h3>\n

En el caso actual, el proceso de nominaci\u00f3n se inici\u00f3 el 20 de marzo de 2024, cuando el Ejecutivo envi\u00f3 al Senado los pliegos de los candidatos para su correspondiente acuerdo. Posteriormente, el 15 de abril, se publicaron en el Bolet\u00edn Oficial los antecedentes de ambos juristas y se activaron los procedimientos de consulta y participaci\u00f3n ciudadana. Luego de cumplirse todas las instancias requeridas, la administraci\u00f3n remiti\u00f3 los mensajes al Senado el 27 de mayo de 2024 para solicitar su aprobaci\u00f3n.<\/h3>\n

El 21 y 28 de agosto se llevaron a cabo las audiencias de Lijo y Garc\u00eda-Mansilla, respectivamente. Tras estas instancias, ambos candidatos quedaron en condiciones de obtener dictamen y ser sometidos a votaci\u00f3n en la C\u00e1mara Alta. Sin embargo, sus pliegos no fueron tratados durante el per\u00edodo ordinario de sesiones. Ante esta situaci\u00f3n, el Presidente opt\u00f3 por incluir la cuesti\u00f3n en el temario de las sesiones extraordinarias del Congreso, aunque el Senado tampoco dio curso al proceso.<\/h3>\n

Debido a \u201cla inacci\u00f3n del Senado y al prolongado estancamiento del proceso\u201d, el Ejecutivo decidi\u00f3 avanzar con la designaci\u00f3n en comisi\u00f3n de los jueces, amparado en el art\u00edculo 99, inciso 4, de la Constituci\u00f3n Nacional, que faculta al Presidente a realizar nombramientos transitorios en caso de vacantes durante el receso legislativo. La medida estar\u00e1 vigente hasta la finalizaci\u00f3n del pr\u00f3ximo per\u00edodo legislativo.<\/h3>\n
