{"id":3353,"date":"2023-09-15T18:56:48","date_gmt":"2023-09-15T21:56:48","guid":{"rendered":"https:\/\/apuntesdesanluis.com\/?p=3353"},"modified":"2023-09-15T18:56:48","modified_gmt":"2023-09-15T21:56:48","slug":"la-justicia-de-estados-unidos-dejo-firme-el-millonario-fallo-contra-la-argentina-por-estatizar-ypf","status":"publish","type":"post","link":"https:\/\/apuntesdesanluis.com\/index.php\/2023\/09\/15\/la-justicia-de-estados-unidos-dejo-firme-el-millonario-fallo-contra-la-argentina-por-estatizar-ypf\/","title":{"rendered":"LA JUSTICIA DE ESTADOS UNIDOS DEJ\u00d3 FIRME EL MILLONARIO FALLO CONTRA LA ARGENTINA POR ESTATIZAR YPF"},"content":{"rendered":"<h3>La Justicia de Estados Unidos dej\u00f3 firme hoy el fallo por la expropiaci\u00f3n de YPF que obligar\u00eda a la Argentina a desembolsar una suma multimillonaria al fondo de inversi\u00f3n Burford.<\/h3>\n<h3>La jueza de Nueva York Loretta Preska dispuso que la Argentina deber\u00e1 pagar US$ 16.099 millones por la decisi\u00f3n que en su momento tomaron Cristina Kirchner y quien por entonces era su ministro de Econom\u00eda, Axel Kicillof.<\/h3>\n<h3>El 16 de abril de 2012 el gobierno argentino anunci\u00f3 la decisi\u00f3n de expropiar el 51% de las acciones de YPF pertenecientes a la petrolera espa\u00f1ola Repsol.<\/h3>\n<h3>A partir de all\u00ed se desencadenaron acontecimientos que derivaron en este fallo.<\/h3>\n<h3>La ahora vicepresidenta Cristina Kirchner acus\u00f3 a los fondos buitres de &#8220;sobornar&#8221; a jueces para que emitan fallos a su favor.<\/h3>\n<h3>Una semana despu\u00e9s de dar a conocer su resoluci\u00f3n, la jueza de Nueva York Loretta Preska public\u00f3 la sentencia final del juicio por la expropiaci\u00f3n de YPF.<\/h3>\n<h3>Se trata de un fallo por el que la Argentina deber\u00e1 pagarle poco m\u00e1s de 16.000 millones de d\u00f3lares al fondo Burford por haber expropiado de manera indebida las acciones de YPF que pertenec\u00edan a la petrolera Repsol y al grupo Eskenazi.<\/h3>\n<h3>La Argentina pretend\u00eda pagar no m\u00e1s de 5.000 millones de d\u00f3lares.<\/h3>\n<h3>La diferencia entre la cifra de la sentencia y la pretensi\u00f3n argentina radicaba en calcular intereses seg\u00fan la fecha de la irrupci\u00f3n de los funcionarios en YPF y la fecha en que la expropiaci\u00f3n fue aprobada por ley del Congreso.<\/h3>\n<h3>El gobierno argentino quer\u00eda que la jueza Preska indicara que la fecha de expropiaci\u00f3n hab\u00eda sido el 7 de mayo de 2012, cuando sali\u00f3 la ley de expropiaci\u00f3n. De esa forma, la compensaci\u00f3n ser\u00eda desde ese d\u00eda.<\/h3>\n<h3>Adem\u00e1s, el pa\u00eds buscaba que la tasa de inter\u00e9s anual retroactiva que le iban a aplicar (desde 2012, cuando se expropi\u00f3, a 2023) fuera del 0%. Eso dar\u00eda cerca de US$ 5.000 millones.<\/h3>\n<h3>El fondo Burford consideraba que la intervenci\u00f3n de YPF se materializ\u00f3 el 16 de abril, cuando el ministro de Econom\u00eda de ese momento -Axel Kicillof- fue nombrado interventor de la empresa y desplaz\u00f3 a los accionistas privados. Desde ese momento hasta el 7 de mayo, las acciones de YPF cayeron un 25%.<\/h3>\n<h3>En ese escenario, Burford hubiera cobrado alrededor de US$ 8.300 millones, aun con un 0% de inter\u00e9s, como quer\u00eda Argentina.<\/h3>\n<h3>De todas formas, los litigantes aspiraban a que les reconocieran una tasa del 8% anual, lo que llevar\u00eda el cheque a US$ 16.000 millones, lo que finalmente decidi\u00f3 la jueza.<\/h3>\n<h3>Es decir que la magistrada se inclin\u00f3 por la mayor penalizaci\u00f3n para la Argentina.<\/h3>\n<h3>La Argentina reserv\u00f3 su derecho de apelar.<\/h3>\n<h3>La Argentina reafirm\u00f3 su voluntad de cooperar de buena fe con los pedidos de la justicia de Estados Unidos de trabajar sobre de monto de la f\u00f3rmula determinado en el juicio por la nacionalizaci\u00f3n de YPF, al tiempo que reiter\u00f3 que se reserva su derecho de presentar la apelaci\u00f3n de la sentencia final en el caso.<\/h3>\n<h3>As\u00ed lo indic\u00f3 la defensa del Estado argentino a cargo del estudio de abogados Sullivan &amp; Cromwell, en un carta enviada a la jueza Preska.<\/h3>\n<h3>&#8220;La Rep\u00fablica respetuosamente discrepa de que estas cifras de da\u00f1os sean correctas y adem\u00e1s no est\u00e1 de acuerdo con las sentencias de responsabilidad del Tribunal y se reserva todos sus derechos de apelaci\u00f3n&#8221;, aclara la defensa, que tiene un per\u00edodo de 30 d\u00edas para realizar el pedido formal.<\/h3>\n<h3>La misiva es en realidad una respuesta a una carta enviada por los representantes del grupo Petersen y Eton Park, del estudio Kellog, Hansen y asociados, quienes acusaron al pa\u00eds &#8220;de que se ha negado a conferir de buena fe con los demandantes para preparar un presentaci\u00f3n conjunta&#8221;, afirm\u00f3 el abogado litigante Dereck Ho.<\/h3>\n<h3>El pasado 8 de septiembre, apenas se conoci\u00f3 el fallo en contra del pa\u00eds sobre la f\u00f3rmula para calcular el monto de la sentencia emitida en marzo de 2023, el Gobierno nacional anunci\u00f3 que iba a apelar &#8220;inmediatamente&#8221;.<\/h3>\n<p>El estudio de abogados Sullivan &amp; Cromwell manifest\u00f3 &#8220;su desacuerdo con la decisi\u00f3n sin precedentes y err\u00f3nea de la corte de distrito&#8221; de Nueva York, y ratific\u00f3 &#8220;la intenci\u00f3n de apelar la
