Santiago Cabanay Sasso comenz\u00f3 a ser juzgado este mi\u00e9rcoles por la muerte de Marcela Castro, una motociclista de 24 a\u00f1os que fue embestida por una camioneta Toyota Hilux conducida presuntamente por el imputado. El hecho ocurri\u00f3 el 1\u00b0 de febrero de 2017 a la noche en la intersecci\u00f3n de Autov\u00eda Eva Per\u00f3n y San Juan de la ciudad de San Luis y la joven falleci\u00f3 trece d\u00edas despu\u00e9s por las heridas sufridas en el impacto.<\/span><\/h3>\n

En la audiencia de hoy, la fiscal de Juicio, Mar\u00eda Eugenia Zabala Chacur, solicit\u00f3 a la C\u00e1mara Penal N\u00b0 2 Residual de la Primera Circunscripci\u00f3n, que la causa que se investiga concluya bajo el procedimiento de juicio abreviado y que el acusado sea condenado a 3 a\u00f1os de prisi\u00f3n en suspenso y 5 a\u00f1os de inhabilitaci\u00f3n por el delito de homicidio culposo en accidente de tr\u00e1nsito, agravado por la violaci\u00f3n a la se\u00f1alizaci\u00f3n de los sem\u00e1foros.<\/span><\/h3>\n

\u201cEsta Fiscal\u00eda considera que hay elementos suficientes para estimar que al encartado le corresponder\u00eda la imposici\u00f3n de una pena inferior a seis a\u00f1os\u201d, dijo Chacur. En su requisitoria fiscal, la funcionaria explic\u00f3 que el C\u00f3digo Penal Argentino prev\u00e9 para este tipo de delitos una pena m\u00ednima de tres a\u00f1os y una m\u00e1xima de seis, y ante la falta de antecedentes condenatorios del acusado, conforme informe del Registro Nacional de Reincidencias, y de no advertir circunstancias agravantes, la pena propuesta se ajusta a derecho.<\/span><\/h3>\n

El pedido de Chacur cont\u00f3 con el consentimiento de Cabanay Sasso y el Defensor Oficial en lo Penal, Esteban Sala. El abogado querellante, V\u00edctor Lazarte, se opuso al acuerdo. En las pr\u00f3ximas horas el tribunal, integrado por su presidente, Hugo Guillermo Saa Petrino, y las vocal\u00edas de Adriana Lucero Alfonso y Julio Fernando De Viana, informar\u00e1 si homologa o no el acuerdo arribado entre las partes.<\/span><\/h3>\n

El juicio abreviado es una de las formas alternativas de culminar un proceso penal mediante el cual el acusado de un delito reconoce la existencia del hecho, su participaci\u00f3n como autor, c\u00f3mplice o instigador y acepta la calificaci\u00f3n legal que le otorga a ese hecho el fiscal.<\/span><\/h3>\n

Cabanay, de 27 a\u00f1os, reconoci\u00f3 el hecho, admiti\u00f3 su participaci\u00f3n y responsabilidad y acept\u00f3 la propuesta presentada por Fiscal\u00eda.<\/span><\/h3>\n

Castro trabajaba como vendedora en una zapater\u00eda ubicada en 9 de Julio casi Col\u00f3n. Cuando se produjo el choque volv\u00eda a la casa que compart\u00eda con su novio, en el barrio Faecap. Transitaba en su Motomel azul 110 hacia el norte, por calle San Juan, cuando la choc\u00f3 la Toyota Hilux.<\/span><\/h3>\n

El informe pericial elaborado en el marco de la causa, estableci\u00f3 que el conductor de la camioneta se conduc\u00eda por la autov\u00eda Eva Per\u00f3n en direcci\u00f3n de este a oeste a una velocidad superior a los 65 kil\u00f3metros por hora y al llegar a la intersecci\u00f3n con calle San Juan traspasa el cruce de las arterias correspondientes sin atender a la luz roja del sem\u00e1foro que le imped\u00eda el paso.<\/span><\/h3>\n

\u201cDicho cruce antirreglamentario result\u00f3 ser la causa eficiente del impacto de la motocicleta que, habilitada por el sem\u00e1foro, cruzaba dicha intersecci\u00f3n\u201d, dice un fragmento de la acusaci\u00f3n fiscal. El informe m\u00e9dico determin\u00f3 que la muerte de la v\u00edctima se produjo como consecuencia de la gravedad de las lesiones producidas en el choque y que incluyeron traumatismos de t\u00f3rax y encefalocraneano.<\/span><\/h3>\n","protected":false},"excerpt":{"rendered":"
